Break-in suspect pleads guilty to lesser charges

A Kingsley man could spend up to the next two years in prison after pleading guilty to two lesser charges related to the break-in of a Maple City business last month.

Nathaniel R. Kath, 24, of 6188 Summit City Rd., pleaded guilty in 13th Circuit Court Monday as part of a plea bargain arrangement to attempted malicious destruction of fire or police property and drunk driving. In exchange, county Prosecutor Joseph T. Hubbell agreed to drop the more serious charges of breaking and entering a building with intent, possession of burglar tools and malicious destruction of fire or police property. Kath will be sentenced on Monday, April 30 in Leland.

According to court documents, Kath was found sleeping under a cardboard box in the basement of a Maple City business on Friday, Feb. 16. County Sheriff’s deputies were called to the scene by the business owner and a manager who arrived at work in the morning and noticed one of the basement windows had been damaged.

When arrested, Kath was found to have items from the business on his person as well as a small Swiss Army knife and a 31⁄2-inch blade knife with a broken handle.

A vehicle registered to Kath’s family was found stuck in a snowbank about a half-mile away from the Maple City business. Deputies learned Kath had been given a ride to the gas station in Maple City. A clerk at the store said she saw Kath being dropped off, adding that he waited inside the store for a length of time because he said someone was coming to help him get the vehicle out of the snowbank.

After being arrested, county jail officials reported that Kath had destroyed a mattress in his cell.
