Drunk driving, pot charges filed

A Grand Rapids man could spend up to seven years in prison on charges of drunk driving, possession of marijuana and driving while license suspended.

James G. Stokes, 43, of 239 Straight Ave. SW, Grand Rapids, appeared before 86th District Court Chief Judge Michael J. Haley on Friday on charges of third offense felony drunk driving, second offense driving while license suspended, possession of marijuana and habitual offender. A pretrial meeting is scheduled for Friday, June 29 at 10:30 a.m.

Stokes is free on bond, but may not consume or be in possession of alcohol and illegal drugs. He must submit to daily preliminary breath tests and twice monthly random urine screenings.

According to the felony complaint on file with court documents, on the evening of Wednesday, June 14, a Sheriff’s deputy pulled over a minivan on a trail adjacent to Old Mountain Road in Cleveland Township. A deputy detected the odor of alcohol and asked Stokes for his driver’s license and registration. When Stokes did not respond, the deputy opened the door and Stokes fell out of the vehicle. Stokes failed two sobriety field tests, the documents showed, and after his arrest the vehicle was searched and two containers of marijuana were allegedly found.

Stokes has been previously convicted of drunk driving on April 15, 1996, in 59th District Court in Grandville, and on March 3, 1998, in 59th District Court in Walker. He was previously convicted of driving while his license was suspended on Oct. 7, 1998, and on March 30, 2000, in 63rd District Court in Grand Rapids. Stokes was also previously convicted of delivery or manufacture of marijuana on Jan. 13, 2003 in the 17th Circuit Court for Kent County.

If found guilty of the third offense felony drunk driving, Stokes faces a maximum penalty of 1-5 years in jail or prison. His vehicle would be immobilized and he would face a fine of $500 to $5,000. If found guilty of possession of marijuana and the habitual offender clause is invoked, Stokes faces a maximum penalty of up to seven years in prison.
