A Northport man will serve up to eight months in the county Jail after being sentenced on two counts of possession of child sexually abusive material.
Gary N. Mitchell II, 27, of 415 N. Shabwasung St., Northport, was sentenced in the 13th Circuit Court by Judge Thomas G. Power on Thursday, Aug. 2. Mitchell had previously pleaded guilty to the two counts in exchange for county Prosecutor Joseph T. Hubbell dropping three similar charges as part of a plea bargain arrangement.
Mitchell was sentenced to serve up to eight months in jail on both counts, with credit for two days serve; jail time for both counts to be served concurrent; $60 state crime victims fund; $25 local crime victims fund; $800 costs; $1,000 fine; $750 in additional restitution; $60 felony state costs; and two years probation.
According to court documents, on Feb. 18, 2007, Sheriff’s Department deputies received a complaint from a man who had heard from Mitchell’s roommate that she had found child pornography on Mitchell’s computer. After a search warrant was obtained for Mitchell’s apartment, a computer and several other items were confiscated. A review of the computer’s hard drive revealed over 30 child pornographic videos and hundreds of child pornographic digital photos.
