Two Leland Township men were arraigned following a raid at their home last week that resulted in the seizure of nearly $20,000 worth of drugs.
Adan Torres, 30, and Jorge L. Roman, 41, both of 990 S. French Rd., Lake Leelanau, appeared in 86th District Court Friday morning before chief Judge Michael J. Haley. Torres was arraigned on charges of delivery/manufacture of cocaine, 50-449 grams; delivery/manufacture of marijuana; and maintaining a drug house.
Roman was arraigned on a charge of assaulting, resisting, obstructing a police officer, and habitual offender.
Both men are free on bond and will return tomorrow, Aug. 17, at 10 a.m. for a preliminary hearing on the charges.
According to court documents, on Tuesday, Aug. 7 at 11:35 p.m., detectives with the Traverse Narcotics Team (TNT) executed a search warrant for the house. Both Torres and Roman were home at the time of the search.
Officers found about six ounces of a white powder substance that field tests later determined to be cocaine. Further searching revealed 11⁄2 pounds of a green leafy substance that was later determined to be marijuana. The marijuana was found in approximately 21 heat-sealed, separate plastic bags.
Torres was read his Miranda rights and agreed to answer questions, the documents showed. He later allegedly admitted that all the illegal drugs discovered were his and that they came from Texas. He picked them up in Indiana.
When TNT officers entered the home, Roman allegedly refused a command from one of the detectives to get down on the floor, and became combative. During the ensuing struggle, Roman allegedly struck an officer in the right eye with a fist. With the help of another officer, Roman was handcuffed, but continued to be non-compliant and combative.
If Torres is convicted of the first charge, a felony, he faces a maximum penalty of up to 20 years in prison and up to $250,000 fines and costs. If convicted of the second charge, the maximum is up to four years and/or $20,000. A conviction on the third charge, a misdemeanor, could result in up to two years in prison and or $25,000. If he is found guilty on any of the charges and sentenced to one year or less in prison, the court shall impose driver’s license sanctions.
If Roman is convicted on the assault charge, he faces a maximum of up to two years in prison and or $2,000 in fines and costs. He was previously convicted of third offense drunk driving. If the habitual offender clause in invoked, he faces a maximum penalty of up to five years in prison.
