NOTICE OF SALE
Default having been made in the condition of a certain mortgage made the 22nd day of September, 2005, by Wayne H. Mervau, as Trustee on behalf of The Wayne H. Mervau Declaration of Trust Dated March 22, 2002, whose address is 611 W. 13th Street, Traverse City, MI 49684, and by Wayne H. Mervau, a single man, whose address is 611 W. 13th Street, Traverse City, MI 49684 to Northwestern Bank, and recorded on October 19, 2005, in the office of the Register of Deeds for Leelanau County, Michigan, at Liber 876, page 750, and on which mortgage there is claimed to be due and unpaid at the date of this Notice THIRTY SIX THOUSAND SEVEN HUNDRED FIFTY THREE AND 76/100 ($36,753.76) and no suit or proceeding at law or in equity having been instituted to recover the debt, or any part of the debt, secured by said mortgage, and the power of sale in said mortgage contained having become operative by reason of such default.

NOTICE IS HEREBY GIVEN that on January 10, 2008 at 11:00 o’clock in the forenoon at the Courthouse, located at 301 Cedar St., Leland, MI, there will be offered for sale and sold to the highest bidder, at public sale, for the purpose of satisfying the amounts due and unpaid upon said mortgage, together with legal costs and charges of sale, including an attorney fee of Seventy-Five ($75.00) Dollars provided by law and in said mortgage, the lands and premises in said mortgage mentioned and described as follows, to wit:

Village of Northport, Leelanau County, Michigan

Together with riparian rights to the creek that flows along the south property line. Subject to the right-of-way of Third Street. Subject to the right-of-way of Eighth Street. Subject to the right-of-way of Warren Street. Subject to and together with an easement for ingress and egress over the west 33 feet of the South 1/2 of the Southwest 1/4 of Section 34 lying north of Third Street, as recorded in Liber 209 of deeds, page 647. Subject to all applicable building, use restrictions, and easements, if any, affecting the premises.

The redemption period shall be one (1) year from date of sale; provided, however, that if the subject premises are heretofore or hereafter conclusively presumed to have been abandoned pursuant to MCL 600.3241a, the applicable period for redemption shall be thirty (30) days from said date, or otherwise shortened, in accordance with that statute.
