Notice Of Mortgage Foreclosure Sale

ATTN PURCHASERS: This sale may be rescinded by the foreclosing mortgagee. In that event, your damages, if any, shall be limited solely to the return of the bid amount tendered at sale, plus interest.

MORTGAGE SALE - Default has been made in the conditions of a mortgage made by Scott Zygmuntowski and Tina M. Zygmuntowski, Husband and Wife, original mortgagor(s), to Mortgage Electronic Registration Systems, Inc., as nominee for lender and lender’s successors and/or assigns, Mortgagee, dated April 12, 2005, and recorded on May 4, 2005 in Liber 852 on Page 524, in Leelanau county records, Michigan, and assigned by said Mortgagee to IndyMac Bank F.S.B. as assignee, on which mortgage there is claimed to be due at the date hereof the sum of Two Hundred Sixty-One Thousand Nine Hundred Forty-One And 25/100 Dollars ($261,941.25), including interest at 6.625% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue, at the place of holding the circuit court within Leelanau County, at 11:00 AM, on January 18, 2008.

Said premises are situated in Township of Leelanau, Leelanau County, Michigan, and are described as: That part of the South 1/2 of Government Lot 3, Section 9, Town 28 North, Range 11 West, described as: Commencing at the West 1/4 corner of said Section; thence on 1/4 line North 89 Degrees 53 minutes 05 seconds East 439.77 feet; thence South 08 Degrees 42 minutes 00 seconds East 667.88 feet along West Right of Way line of Highway M-22 to North line of South 1/2 of Government Lot 3; thence along said line South 89 degrees 55 minutes 00 seconds West 150.05 feet; thence South 05 degrees 27 minutes 00 seconds East 100.41 feet to the Point of Beginning; thence South 05 Degrees 27 Minutes 00 seconds East 100.41 feet; thence North 89 Degrees 55 minutes 00 seconds East 269.00 feet more or less to Shore of Grand Traverse Bay; thence Northerly along shore 100.00 feet more or less to a point which is North 89 Degrees 55 minutes 00 Seconds East of Point of Beginning; thence South 89 Degrees 55 Minutes 00 Seconds West 260.00 feet more or less to Point of Beginning.

The redemption period shall be 6 months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale.
