MORTGAGE SALE - Default has been made in the conditions of a mortgage made by Stephen Sutherland, a single man, to Option One Mortgage Corporation, a California Corporation, Mortgagee, dated December 20, 2004 and recorded January 10, 2005 in Liber 839, Page 174, Leelanau County Records, Michigan. Said mortgage is now held by Wells Fargo Bank, N.A., as Trustee for MASTR Asset Backed Securities Trust 2005-OPT1 by assignment. There is claimed to be due at the date hereof the sum of One Hundred Ninety-Seven Thousand Two Hundred Sixty-One and 84/100 Dollars ($197,261.84) including interest at 9.95% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue at the Courthouse in Leland, Michigan in Leelanau County, Michigan at 11:00 a.m. on JANUARY 18, 2008.
Said premises are located in the Township of Elmwood, Leelanau County, Michigan, and are described as:
Part of the Southwest one-quarter of Section 24, Town 28 North, Range 12 West, more fully described as: Commencing at the South one-quarter corner of said Section 24; thence along the South Section line South 88 degrees 51 minutes 30 seconds West, 200.00 feet; thence North 00 degrees 03 minutes 50 seconds West, 10.67 feet to a Point on the Northerly right-of-way of Lincoln Road also being the Point of Beginning; thence North 88 degrees 48 minutes 59 seconds West, 50.00 feet along said Northerly right-of way; thence North 13 degrees 09 minutes 16 seconds East, 218.66 feet; thence North 88 degrees 51 minutes 30 seconds East, 200.00 feet to a point on the North-South Quarter Line; thence along said North-South Quarter line South 00 degrees 03 minutes 50 seconds East, 223.52 feet to the point of beginning.
The redemption period shall be 6 months from the date of such sale, unless determined abandoned in accordance with MCLA §600.3241a, in which case the redemption period shall be 30 days from the date of such sale. TO ALL PURCHASERS: The foreclosing mortgagee can rescind the sale. In that event, your damages, if any, are limited solely to the return of the bid amount tendered at sale, plus interest.
