Public Notice - Notice of Final Agency Determination to Take Land "In Trust"


SUMMARY: The Superintendent, Michigan Agency, Bureau of Indian Affairs, U.S. Department of the Interior, on the below date, made a final agency determination to acquire 4 parcels totaling approximately 2.70 acres, more or less, of land “in trust” for the Grand Traverse Band of Ottawa and Chippewa Indians.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR 151.12(b) that notice be given to the public of the decision by the authorized representative of the Secretary of the Interior to acquire land “in trust” at least 30 days prior to signatory acceptance of land “in trust”. The purpose of the 30-day waiting period in 25 CFR 151.12(b) is to afford interested parties the opportunity to seek judicial review of administrative decisions to take land “in trust” for tribes or individual Indians before transfer of title to the property occurs. On January 22, 2008, the Agency Superintendent, Michigan Agency, made a determination to accept approximately 2.70 acres, more or less, of land “in trust” for the Grand Traverse Band of Ottawa and Chippewa Indians, pursuant to the Indian Reorganization Act (IRA) of June 18, 1934 (48 Stat. 984; 25 U.S.C. 465).

The Superintendent, Michigan Agency, on behalf of the Secretary of the Interior, shall acquire title in the name of the United States of America “in trust” for the Grand Traverse Band of Ottawa and Chippewa Indians to the following parcels of land no sooner than 30 days after the date this notice is published in newspapers of general circulation within the State of Michigan, County of Leelanau.

The subject properties are described as:
Parcel 31: That part of Lot 2, Block 5 except the easterly half lying east of the railroad tracks, according to the plat of Village of Peshawbestown recorded with the Leelanau County Register of Deeds, located in Section 11, Town 30 North, Range 11 West, Michigan Meridian. Containing .50 acre, more or less.

Parcel 51: A part of Lot 12, Block 2, according to the Plat of Village of Peshawbestown recorded with the Leelanau County Register of Deeds, acquired by Warranty Deed executed February 11, 1999 recorded with the Leelanau County Register of deeds in Liber 503 Pages 484-85, located in Section 2, Town 30 North, Range 11 West, Michigan Meridian, more specifically described as follows:

A parcel of land described as being a park of Lot Numbered Twelve (12) of Block Two (2) of the Village of Peshawbestown, according to the plat thereof as recorded in Liber 1 of Plats, pages 1, 2 and 3 in the office of the Register of Deeds for Leelanau County, Michigan and more particularly described as: Beginning at a point in the center of State Highway M-22 which is a projection of said Lot Twelve (12) on the south side; thence West Three Hundred Thirty-three (333.0) feet along the South line of said Lot Twelve (12); thence North Seventy-five (75) feet; thence East, parallel to the South line of said Lot Twelve (12) a distance of 333.0 feet to the centerline of M-22; thence South 75 feet, more or less, along the centerline of said highway to the place of beginning. Containing .57 acres, more or less. (Being a parcel of land 333.0 feet East and West by 75 feet North and South).

Parcel 53: Those parts of Lots 3 and 4, Block 4 in Government Lot 2, according to the plat of Village of Peshawbestown recorded with the Leelanau County Register of Deeds, acquired by Warranty Deed executed May 28, 1999 recorded with the Leelanau County Register of Deeds in Liber 517 Pages 496-97, located in Section 11, Town 30 North, Range 11 West, Michigan Meridian, more specifically described as follows:

Land in Lots 3 and 4 of Block 4, Village of Peshawbestown in Government Lot 2, Section 11, Town 30 North, Range 11 West, described more fully as follows: Commencing at the West 1/4 corner of Section 11; thence South 89 degrees 28’ 40” East along the East and West 1/4 line, 987.43 feet to the shore of Grand Traverse Bay; thence North 34 degrees 02’ 50” East along said shore, 743.34 to the Place of Beginning; thence continuing North 34 degrees 02’ 50” East along said shore, 68.14 feet; thence North 17 degrees 49’ 10” East along said shore, 38.86 feet; thence North 78 degrees 32’ 10” West, 216.45 feet to the Easterly right of way line of Leelanau Transit Co Railroad; thence South 34 degrees 59’ 50” West, along said right of way line, 100.00 feet; thence South 76 degrees 12’ 50” East 226.09 feet to the Place of Beginning. Including all land between the sidelines of the above tract extended to the waters of Grand Traverse Bay, together with easement for ingress and egress to and from Highway M-22 over private easements shared with other tracts lying in above said Lots 3 and 4 and described in detail as follows: Beginning on the Easterly right of way line of above said Railroad at a point North 34 degrees 59’ 50” East, 699.00 feet from the intersection of said right of way line with the East and West 1/4 line of Section 11; thence North 34 degrees 59’ 50” East, along said right of way line, 315.89 feet; thence South 83 degrees 11’ 45” East, 22.69 feet; thence South 34 degrees 59’ 50” West, 326.61 feet; thence North 55 degrees 00’ 10” West, 20.00 feet to the Place of Beginning of said easement and the Place of Beginning of the centerline of another existing 30.00 foot wide access drive easement leading North 55 degrees 00’ 10” West, 330.00 feet more or less to the centerline of State of Highway M-22. Containing .53 acres, more or less.

Parcel 63: Lot 19, Block 3, according to the plat of Village of Peshawbestown recorded with the Leelanau County Register of Deeds, located in Section 11, Town 30 North, Range 11 West, Michigan Meridian. Containing 1.10 acre, more or less.
