Two more lawsuits against the developer of the BayView project in Suttons Bay have been resolved in recent weeks, reducing the number of active suits pending against the developer in 13th Circuit Court this year from nine to six.
Most recently, a suit filed by Casey Edick Construction of Leelanau County against BayView developer Suttons Pointe Development, L.L.C., was dismissed on Feb. 1. The local contractor had offered to settle the case for $30,304 – the amount he said he was owed by the developer for work completed in 2006 and 2007.
On Jan. 28, according to court records, a suit against Suttons Pointe and its “resident agent” Marcus W. Yono, filed by Molon Excavating of Traverse City, was closed following a mediation session. Molon had claimed that the developer owed nearly $90,000 for work the contractor completed in 2006, but offered to settle for $68,000 if payment is received by Aug. 31.
Earlier last month, Great Lakes Caulking and Waterproofing settled its suit against Yono and his companies. Great Lakes had alleged it was owed nearly $27,000 and offered to settle for that amount.
Six other lawsuits against the developer were still pending in Circuit Court this week, according to court records. Three are from people who want their deposits back on BayView units they no longer want to buy. One is a potential class action suit from a number of BayView condo owners, one is from a furniture supplier, and one is from a bank foreclosing on a mortgage the developer took out on a BayView unit. In addition, another mortgage provider has issued a notice that it will hold a foreclosure sale on Feb. 29 in connection with another BayView unit the developer borrowed against.
