Settlement leaves 4 suits pending against BayView

Another lawsuit against the developer of the troubled BayView project in Suttons Bay has been resolved out of court.

The latest settlement brings to four the number of cases now pending against the developer. Nine cases were pending against the developer at the beginning of 2008.

On Feb. 21, an order was entered in Circuit Court in Leelanau County closing the case of Vandrie Home Furnishings v. Livingston Building Company and Suttons Pointe Development, L.L.C. The furniture supplier had alleged that the developer was provided more than $23,000 in furniture, didn’t pay for it, and subsequently sold the furniture as part of a “furnished unit” in the BayView condos. VanDrie had asked for a judgment of nearly $70,000.

The order closing the case noted that a settlement had been reached and that all claims had been resolved out of court.

Still pending against the developer are two suits from people who want their deposits back on BayView units; another is a potential class action suit from a number of BayView condo owners, and another is from a bank foreclosing on a mortgage the developer took out on a BayView unit.
