Man sentenced in bottomlands case

An Elmwood Township man has been ordered to pay $250 in court costs for building a gazebo and permanent dock on Lake Michigan bottomland on West Grand Traverse Bay.

David J. Colby, 61, of 1180 S. W. Bay Shore Dr., Traverse City was sentenced in 86th District Court on Friday by Judge John D. Foresman for placing material on bottomland without obtaining the proper permits. Colby’s punishment was issued under delayed sentencing rules, meaning if he completes all requirements of his probation the charge will be dismissed. He also received a one-year non-reporting probation.

According to court documents, Colby built or had erected on his waterfront property a gazebo and permanent dock below the ordinary high water mark on West Bay bottomland without first obtaining approval from the Michigan Department of Environmental Quality.

The maximum penalty Colby faced was up to one year in jail and or paying $1,000 in fines and costs.
