Notice Of Mortgage Foreclosure Sale

ATTN PURCHASERS: This sale may be rescinded by the foreclosing mortgagee. In that event, your damages, if any, shall be limited solely to the return of the bid amount tendered at sale, plus interest.
MORTGAGE SALE - Default has been made in the conditions of a mortgage made by James Swartout and Sandra Swartout, husband and wife, original mortgagor(s), to Chase Manhattan Mortgage Corp., Mortgagee, dated November 27, 2002, and recorded on December 12, 2002 in Liber 698 on Page 563, in Leelanau county records, Michigan, on which mortgage there is claimed to be due at the date hereof the sum of Two Hundred Eight Thousand One Hundred Forty-Seven And 37/100 Dollars ($208,147.37), including interest at 7.75% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue, at the place of holding the circuit court within Leelanau County, at 11:00 AM, on April 18, 2008.
Said premises are situated in Township of Solon, Leelanau County, Michigan, and are described as: Part of the Southwest 1/4 of Section 35, Town 28 North, Range 12 West more fully described as: Commencing at the West quarter corner of said Section 35; thence along the East and West quarter line, North 89 degrees 50 minutes 45 seconds East 2144.46 feet to the point of beginning; thence along said quarter line, North 89 degrees 50 minutes 45 seconds East 491.64 feet; thence along the North and South quarter line, South 01 degrees 15 minutes 35 seconds West 1264.08 feet; thence North 88 degrees 44 minutes 25 seconds West 510.00 feet; thence North 01 degrees 15 minutes 35 seconds East 358.62 feet; thence South 88 degrees 44 minutes 25 seconds East 37.84 feet; thence North 00 degrees 00 minutes 45 seconds East 893.44 feet to the point of beginning.
The redemption period shall be 12 months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale.
