The Michigan State Court of Appeals last week refused to hear a request by a Lake Leelanau woman to have her perjury conviction revisited.
The state appeals court turned down a request by Faye Robyn O’Non, 53, to consider overturning her conviction in Leelanau County for lying on the stand during her son's double murder trial in 2004.
O’Non is serving a 3-15 year sentence at Camp White Lake in Oakland County. Her earliest release date is Sept. 3, 2009. She has one more appeal available - to the state Supreme Court.
Leelanau County Deputy Prosecutor Doug Donaldson was not surprised by the decision, which the appeals court stated was made for “lack of merit in the grounds presented.”
“It was a very fact-driven case,” said Donaldson. “If you look at her testimony, it was clearly designed to negate the elements of premeditated murder.”
Robyn O’Non testified on behalf of her son, who was convicted on two counts of first degree murder for gunning down two drug dealers at the O’Non family cottage on Bass Lake in Leelanau Township. Matt O'Non is serving a mandatory life sentence at the Carson City Correctional Center.
Her husband, Nicholas O'Non, accepted a plea agreement because of his actions leading up to the trial and his testimony on his son's behalf. He pleaded guilty to attempted evidence tampering, and has already served six months in the Leelanau County Jail.
A second son, Chris, is serving time in a federal prison for drug charges.
