AN ORDINANCE TO AMEND THE LEELANAU TOWNSHIP
ZONING ORDINANCE TEXT
THE TOWNSHIP OF LEELANAU ORDAINS:
SECTION 1. AMENDMENT OF ZONING ORDINANCE SECTIONS - An ordinance to amend various sections of the Leelanau Township Zoning Ordinance has been adopted by the Leelanau Township Board for the purpose of complying with the requirements of the most recent MZEA (Michigan Zoning Enabling Act) legislation to amend the Leelanau Township Zoning Ordinance by repealing the existing text of Article 13 – Planned Site Option, and renaming Article 13 to “Open Space Residential Developments” and inserting new text; complete with adjunct housekeeping amendments to Article 2 – Definitions, Article 3 – Land Use Districts, Article 5 – Residential Districts, Article 11 – Site Plan Review.
SECTION 2. SEVERABILITY
If any section, clause, or provision of this Ordinance be declared unconstitutional or otherwise invalid by a court of competent jurisdiction, said declaration shall not affect the remainder of the Ordinance. The Township Board hereby declares that it would have passed this Ordinance and each part, section, subsection, phrase, sentence and clause irrespective of the fact that any one or more parts, sections, subsections, phrases sentences, or clauses be declared invalid.
SECTION 3. CONFLICTS
If any section, clause, or provision of the Ordinance is declared unconstitutional or otherwise invalid by a court of competent jurisdiction, said declaration shall not affect the validity of the remainder of the Ordinance as a whole or any part thereof, other than the part so declared to be unconstitutional or invalid.
SECTION 4. EFFECTIVE DATE.
This Ordinance shall become effective eight (8) days after being published in a newspaper of general circulation within the Township. A copy of this ordinance is available at the Leelanau Township Hall on the date of publication.
