MORTGAGE SALE - Default has been made in the conditions of a mortgage made by John LaBonte and Wendy LaBonte, husband and wife, to Mortgage Electronic Registration Systems, Inc., as nominee for lender and lender’s successors and/or assigns, Mortgagee, dated July 27, 2007 and recorded August 2, 2007 in Liber 949, Page 114, Leelanau County Records, Michigan. There is claimed to be due at the date hereof the sum of One Hundred Thirty-Four Thousand Three Hundred Fifty-Two and 64/100 Dollars ($134,352.64) including interest at 12.275% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue at the
Leelanau County Courthouse, 8527 E. Government Center Drive, Suttons Bay in Leelanau County, Michigan at 11:00 a.m. on APRIL 25, 2008.
Said premises are located in the Township of Elmwood, Leelanau County, Michigan, and are described as:
That part of the Southwest one-quarter of Section 12, Town 28 North, Range 12 West, more fully described as: Commencing at the Southwest corner of said Section 12; thence North 88 degrees 33 minutes 20 seconds East, along the South Section line, 200.00 feet to the Point of Beginning; thence North 00 degrees 09 minutes 20 seconds West, 472.25 feet; thence South 85 degrees 26 minutes 15 seconds West, 200.53 feet; thence North 00 degrees 09 minutes 20 seconds West, along the West Section line, 896.88 feet; thence North 88 degrees 38 minutes 25 seconds East, along the South one-eighth line, 400 feet; thence South 00 degrees 09 minutes 20 seconds East, 1357.24 feet; thence South 88 degrees 33 minutes 20 seconds West, along the South Section line, 200.00 feet to the Point of Beginning. Subject to the former railroad right-of-way.
The redemption period shall be 12 months from the date of such sale, unless determined abandoned in accordance with MCLA §600.3241a, in which case the redemption period shall be 30 days from the date of such sale. TO ALL PURCHASERS: The foreclosing mortgagee can rescind the sale. In that event, your damages, if any, are limited solely to the return of the bid amount tendered at sale, plus interest.
