A Lake City man could spend as much as 20 years in prison after police found small quantities of marijuana and the drug ecstasy in his vehicle.
James M. Keeley II, 26, of 380 E. Walker Rd., Lake City appeared in 86th District Court on Friday for a preliminary hearing on charges of second offense delivery/manufacture of a controlled substance, methamphetamin (also known as ecstasy), and second offense possession of marijuana. On May 24, 2000, Keeley was convicted for possession of marijuana.
According to court documents, on March 20 Keeley was pulled over on M-22 in Suttons Bay Township by two county sheriff's deputies for driving with a defective headlight. As the deputies approached the vehicle, they allegedly detected the scent of burned marijuana. When asked by one of the deputies where the marijuana was, Keeley allegedly handed a plastic bag containing a substance that was later proven to be marijuana. A subsequent search of Keeley’s vehicle yielded three colored pills, which were later determined to be ecstasy.
If found guilty on the first charge, a felony, Keeley faces a maximum penalty of up to 10 years in prison and or a $15,000 fine. If he is found guilty and the charge is considered a second offense by the court, the maximum penalty for either the prison or fine, or both, can be doubled. If found guilty on the second charge, a misdemeanor, he faces a maximum of up to one year in jail and or $500 fine. Those maximums may also be doubled if the second offense clause is invoked.
