Telecom firm files 2nd suit over lost contract

A company that failed to win a contract to install voice and data cabling in the new Leelanau County Government Center is suing the county - again.

Great Lakes Telecom, owned by Ted Apostoleris of Suttons Bay and located in Elmwood Township, is now suing county administrator David Gill and county information technology coordinator Ron Plamondon individually in a case filed this week in Circuit Court in Leelanau County.

Last year, Aposteleris brought his complaints about the selection of another contractor for the Government Center project directly to the Leelanau County Board of Commissioners.

After hearing his complaints, however, the county board took no action. In November 2007, Great Lakes Telecom filed suit against Leelanau County for a breach of contract.

Leelanau County chief assistant prosecutor Doug Donaldson represented the county in the case and filed a successful motion to have the case remanded from Circuit Court to 86th District Court because the amount in controversy was less than $25,000.

That case was dismissed last week when neither the plaintiff nor his attorney appeared for a scheduled pre-trial hearing in 86th District Court.

The suit filed this week in Circuit Court asserts that Great Lakes Telecom “would have had profits in excess of $25,000” had it not lost the contract with the general contractor on the project, Devere Construction, to install telecommunications cable in the new Government Center.

The suit alleges that Gill and Plamondon “intentionally interfered” with the bidding process and misled Aposteleris about the bid specifications because they didn’t like him, among other allegations.

Gill said Tuesday that he had not yet seen the lawsuit and could not comment on pending litigation. He indicated that the county’s insurance carrier would likely assign an attorney to defend him and Plamondon.
