An association of Sugar Loaf area townhouse owners is threatening to sue Sugar Loaf Resort owner Kate Wickstrom unless she either fixes their common parking lot at the resort or lets townhouse owners fix the parking lot themselves.
“That parking lot is a real shambles,” said Tony Mattar of Oakland County, a director of the townhouse owners association. “The owner of Sugar Loaf Resort has an obligation to maintain the parking lot according to the deed – but it’s not happening,” Mattar said.
Mattar noted that in 2005, when Wickstrom acquired the resort, she allowed members of the townhouse association to repair a portion of the parking lot and pay for it themselves.
“Now, her lawyer is telling us we can’t even have access to the parking lot – which is absurd,” Mattar said.
“We can’t access our townhouses without using the easement we’ve always had on the parking lot,” he said.
In a May 23 letter to an attorney representing the townhouse owners, Wickstrom’s attorney warned the townhouse owners that they are “not permitted to undertake any action ‘on behalf’ of my client and that any access or attempted access by your client (the townhouse owners) or the exercise of any rights by your client with regard to my client’s (Wickstrom’s) property will be met with legal process.”
In a May 21 letter to Wickstrom’s attorney, Joe Quandt, townhouse owners’ association attorney James Romzek wrote that terms of Wickstrom’s obligation to the townhouse owners were clear.
“If your client (Wickstrom) does not wish to meet the townhouse owners half-way or otherwise does not intend to comply with her legal responsibilities and obligations, the owners will take any and all actions to which they are entitled, including, but not limited to, having the repairs commenced on your client’s behalf, contacting the applicable legal authorities or suing for legal relief.”
