NOTICE OF CREATION OF SPECIAL ASSESSMENT
SEWER DISTRICT FOR TIMBER SHORES AREA

To: The Residents and Property Owners of the Township of Leelanau, Leelanau County, Michigan, and Any Other Interested Persons:
PLEASE TAKE NOTICE that as a result of Petitions of property owners, dated December 13, 2006, addressed to the Township of Leelanau, signed by the record owners of lands within the Township containing more than fifty (50%) percent of the total area of the hereinafter-described sanitary sewer special assessment district, the Township Board of the Township of Leelanau proposes to create the afore-described area as a special assessment district for the recovery of any and all costs incurred by said Township in its operation, repair, replacement and maintenance of a sanitary sewer system to be constructed by petitioners in said area in the event the Township is required to assume such obligations because of the default of others to perform such obligations. Such potential costs, estimated at $81,000 for the community septic/drain field preliminary system and $402,000 for the subsequent mechanical system per year, would include engineering, operation, legal, publication, administrative, construction and other necessary and pertinent expenses. Said special assessment district is proposed to be known as “Timber Shores 2008-1 Sanitary Sewer Special Assessment District.”
PLEASE TAKE FURTHER NOTICE that said Special Assessment District within which the foregoing costs may be incurred by the Township and which will be recovered by assessments against all benefited properties within said district is more particularly described on Exhibit A, following, and which is an integral part of the within notice. Such legal description includes the Planned Unit Development known as Timber Shores plus an additional smaller 200’ x 435’ parcel also hereinafter-described, located between Overlook Road and Highway M-22 adjacent to the east line of the south westerly portion of said Timber Shores.
PLEASE TAKE FURTHER NOTICE that the Township Board has reviewed engineering plans showing the proposed Timber Shores development and improvements and has placed the same on file with the Township Clerk for public examination. It has, by Resolution, entered into an agreement with the owners and developers of Timber Shores in which it has agreed to assume the foregoing obligations, financially supported by assessments within the aforementioned special assessment district, following the construction of said sanitary sewer system by developers and in the event the foregoing obligations of operation, repair, replacement, maintenance and other necessary obligations are not properly performed by others for the benefit and use of benefited property owners within the aforesaid district. Such Township obligations, if any, will include periodic redetermination of annual costs which could increase annually based on the Consumers Price Index increase in the cost of living as determined by the Federal Department of Labor.
PLEASE TAKE FURTHER NOTICE that the Township Board has tentatively found the aforementioned Petitions to the Township involving said Timber Shores project to be in compliance with statutory requirements.
PLEASE TAKE FURTHER NOTICE that the aforesaid plans, special assessment district, cost estimates, and Petitions may be examined at the Office of the Township Clerk in the Leelanau Township Hall from the date of the within Notice until and including the date of the public hearing scheduled thereon and may further be examined at such public hearing.
PLEASE TAKE FURTHER NOTICE that a public hearing upon such Petitions, plans, special assessment district and estimate of potential Township costs to be recovered by special assessment from benefitted properties within said district, will be held at the Leelanau Township Hall at 119 East Nagonaba Street, Northport, Michigan commencing at 7 p.m. on July 8, 2008.
At such hearing, the Township Board will consider any written objections to any of the foregoing matters which might be filed with the Board at or prior to the time of said hearing and will further accept and consider any oral comments at said hearing.
PLEASE TAKE FURTHER NOTICE that the Leelanau Township Board will provide necessary and reasonable auxiliary aids and services, to individuals with disabilities at the hearing upon reasonable notice to the Leelanau Township Clerk of the need for the same at least five days prior to the aforesaid hearing.
