MORTGAGE SALE - Default has been made in the conditions of a mortgage made by Clifford J Diotte and Pamela A Diotte, husband and wife, original mortgagor(s), to Option One Mortgage Corporation, a California Corporation, Mortgagee, dated September 22, 2006, and recorded on September 28, 2006 in Liber 916 on Page 153, and modified by agreement dated January 23, 2008, and recorded on May 9, 2008 in Liber 978 on Page 3, in Leelanau county records, Michigan, on which mortgage there is claimed to be due at the date hereof the sum of Two Hundred Twenty-One Thousand Three Hundred Eighteen And 63/100 Dollars ($221,318.63), including interest at 8% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue, at the place of holding the circuit court within Leelanau County, at 11:00 AM, on July 25, 2008.
Said premises are situated in Township of Cleveland, Leelanau County, Michigan, and are described as: Part of the North 1/2 of the Southeast 1/4 of Section 27, Town 29 North, Range 13 West, Cleveland Township, Leelanau County, Michigan, more fully described as follows: Commencing at the East 1/4 corner of said Section 27; thence along the East-West 1/4 line of said section, South 89 degrees 48 minutes 15 seconds West, 538.72 feet to the Point of Beginning; thence continuing along said 1/4 line and within the right of way of Hlavka Road, South 89 degrees 48 minutes 15 seconds West, 270.00 feet; thence South 00 degrees 14 minutes 14 seconds East, 325.23 feet; thence North 89 degrees 45 minutes 46 seconds East 270.00 feet (recorded as North 89 degrees 48 minutes 15 seconds East); thence North 00 degrees 14 minutes 14 seconds West 325.04 feet to the Point of Beginning.
Subject to the right of the public over and across Hlavka Road.
Subject to a 10 foot wide utility easement over and across part of the North 1/2 of the Southeast 1/4 of Section 27, Town 29 North, Range 13 West, Cleveland Township, Leelanau County, Michigan, the centerline being more fully described as follows: Commencing at the East 1/4 corner of said Section 27; thence along the East-West 1/4 line of said Section, South 89 degrees 48 minutes 15 seconds West, 688.34 feet to the Point of Beginning of said easement centerline; thence South 00 degrees 14 minutes 14 seconds East 26.26 feet, thence, parallel with said 1/4 line and North property line, South 89 degrees 48 minutes 15 seconds West, 120.38 feet to the Point of Ending of said easement centerline.
The redemption period shall be 6 months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale.
