The Leelanau County Brownfield Redevelopment Authority (LCBRA) this week took action directed by the Leelanau County Board of Commissioners that may expedite the cleanup and sale of the former county courthouse campus in Leland to local developers, Varley-Kelly Properties, L.L.C.
The $2.4 million sale of the property has been delayed in part by the discovery that water of sufficient quality to serve the 20-plus unit residential development planned for the 2.4-acre property may not be available unless developers dig a community well off-site.
The county board had agreed to delay a planned June 1 closing on its sale to Varley-Kelly by effecting a land contract until a county attorney noted that the county itself cannot extend credit to anyone through a land contract. Land contract terms offered through the LCBRA, however, would be permitted under state law – and will be accomplished following action this week by the LCBRA board acting at its regular monthly meeting.
A motion by board member and county administrator David Gill, seconded by District No. 2 commissioner and LCBRA board member Mark Walter, called on the LCBRA to use its own environmental consultants to conduct an aquifer analysis of the site to see if a deeper well will produce water of sufficient quality to serve the proposed new development. In the same motion, the LCBRA agreed to extend a land contract to Varley-Kelly that will delay the sale of the Leland property for up to 180 days while additional testing is conducted.
The motion carried 7-0, with board member Kathy Finch absent.
In other business this week, the LCBRA board also:
• Discussed the status of a Michigan Department of Environmental Quality loan that is being used to underwrite much of the testing done on the Leland property.
• Heard from a consultant about contract arrangements for another Brownfield project now in the planning stages on the West Bay waterfront in Grelickville.
• Heard an update from County Planning and Community Development director Trudy Galla on an EPA Petroleum Assessment Grant project.
• Reviewed the board’s budget rules and rules of procedures.
• Heard reports on various conferences attended by board members and staff.
