Public notices for Leelanau County

Michigan law requires local governments to inform their citizenry through public notices published in newspapers of record for their communities. These notices provide residents with an easy path for following the work of their elected officials. Public notices for Leelanau County can also be accessed online at Leelanaunews.com.

Kasson Township Accepting Bids

The Kasson Township Board is accepting bids for a two year service contract for the following: 1) Snow Removal at the Kasson Township Hall and the Fire Suppression Well in Maple City. The bid should state the per incident cost for snow removal and if that cost includes any incidentals such as sanding.

Bids may be sent to Clerk, PO BOX 62, Maple City, MI 49664-0062 and must be received by 3 PM on Thursday, October 27, 2016.

Elmwood Township Notice to the Public

Notice of Public Hearing on the Special Assessment Roll for the Blue Ridge Lane, Old Orchard Road and South Orchard Way Special Assessment District Public Act 188 of 1954, as Amended

Elmwood Charter Township Leelanau County, Michigan

TO: THE RESIDENTS AND PROPERTY OWNERS OF LAND WITHIN THE SPECIAL ASSESSMENT DISTRICT AND ANY OTHER INTERESTED PERSONS

PLEASE TAKE NOTICE that the township supervisor/township assessor has reported to the township board and filed in the office of the township clerk for public examination a special assessment roll prepared by him/her covering all properties within the Blue Ridge Lane, Old Orchard Road and South Orchard Way Special Assessment District. The special assessment roll has been prepared for the purpose of assessing the costs of the maintenance, snow removal, and lighting on roads within the Special Assessment District. The assessment is in a total amount of $14,740.00 for 2016 and will be reevaluated on an annual basis for one more year.

PLEASE TAKE FURTHER NOTICE that the township supervisor/township assessor has further reported that each eligible parcel of land within the Blue Ridge Lane, Old Orchard Road and South Orchard Way Special Assessment District will pay an annual assessment computed in the following manner: improved parcels will be assessed $190.00; vacant parcels will be assessed $35.00.

PLEASE TAKE FURTHER NOTICE that the township board will hold a public hearing at the Elmwood Charter Township Hall, 10090 E. Lincoln Road, Traverse City, Michigan on October 10, 2016, at approximately 6:05 p.m. for the purpose of reviewing said special assessment roll and hearing any objections thereto. The special assessment roll may be examined at the office of the township clerk during regular business hours of regular business days until the time of the public hearing and may further be examined at the public hearing.

PLEASE TAKE FURTHER NOTICE that appearance and protest at this public hearing is required in order to appeal the amount of the special assessment to the State Tax Tribunal if an appeal should be desired. A property owner or party in interest, or his or her agent, may appear in person at the public hearing to protest the special assessment or may file his or her appearance by letter delivered to the township clerk on or before the day of the public hearing and his or her personal appearance shall not be required. The property owner or any person having an interest in the property subject to the proposed special assessments may file a written appeal of the special assessment with the State Tax Tribunal within thirty (30) days after confirmation of the special assessment roll if that special assessment was protested at this public hearing.

At a session of said Court held in the Leelanau County Circuit Court, State of Michigan, on: 9/21/16.

PRESENT:

HON. CIRCUIT COURT JUDGE

Plaintiff, having filed an Ex Parte Motion for Alternate Service Pursuant to MCR 2.105(I) with this Court, and the Court having reviewed Plaintiff’s Ex Parte Motion and attached exhibits, and the Court being otherwise fully advised in the premises;

NOW THEREFORE:

IT IS HEREBY ORDERED that service of process by Plaintiff on Defendant in the above-captioned matter be done by publication of this Order, and mailing pursuant to the requirements of MCR 2.106(D) as follows:

(D) Publication of Order; Mailing. If the court orders notice by publication, the defendant shall be notified of the action by

(1) publishing a copy of the order once each week for 3 consecutive weeks, or for such further time as the court may require, in a newspaper in the county where the defendant resides, if known, and if not, in the county where the action is pending; and

(2) sending a copy of the order to the defendant at his or her last known address by registered mail, return receipt requested, before the date of the last publication.

(3) Posting on premises for 28 days.

IT IS FURTHER ORDERED to satisfy the requirements of MCR 2.106(C) as follows:

(a) The above cause of action involves an action to quiet title to real estate filed by Plaintiff against Defendant for real estate located in Leelanau County, Michigan; and

(b) Defendant must file a written Answer to Plaintiff’s Complaint filed in the above cause of action within twenty-eight (28) days of the date of the last publication of notice of the above cause of action as required by this Order or within twenty-eight (28) days of the date of service by registered mail, whichever date is later, and

(c) The Answer by Defendant must be filed in the Leelanau County Circuit Court located at 8527 E. Government Center Drive, Suttons Bay, MI 49682;

(d) A failure by Defendant to file an Answer to Plaintiff’s Complaint within the time periods stated above will result in the entry of a Default in favor of Plaintiff and the entry of a Default Judgment in favor of Plaintiff awarding Plaintiff clear title to the real property which is the subject matter of the above cause of action.

Being the same property conveyed to Jerome A. Bazin and Julie Wilhelm, husband and wife by deed dated 8-6-98 and recorded 8-10-98 in Deed Book 483, page 512, in the Office of the Recorder of Leelanau County, Michigan.

The redemption period shall be 6 months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale.

If the property is sold at foreclosure sale under Chapter 32 of the Revised Judicature Act of 1961, pursuant to MCL 600.3278 the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period.

The Suttons Bay Township Board held its regular meeting on September 14, 2016. Present: Supervisor Bahle, Clerk VanHuystee, and Trustees Nixon and Drozdalski. Reports received - Planner, Zoning Administrator, Fire Authority, and Parks & Recreation. Minutes of previous regular meeting were approved. Authorization was received to pay the bills.

Memorial brunch for Sandy Kushner at Herman Park, Sat., Sept. 24; Draft Township Short Term Rental Ordinance reviewed and sent to Twp. Atty.; request Twp. Atty. write legal opinion re: library; Twp. applied for DNR Grant for Forestry Management Plan for Township Parks; Twp. applied to Community Fund Endowment for grant to finish projects at Herman Park.
