Man faces drunk driving charge

A 37-year-old Thompsonville man was arraigned Tuesday in 86th District Court on a charge of felony drunken driving.

Benjamin J. Kitchen did not enter a plea on the charge and is requesting a court-appointed attorney.

Kitchen is currently free on a $10,000 personal recognizance bond.

The case stems from a Nov. 21 accident on South Plowman Road in Empire Township in which Kitchen was driving, according to a court report. The deputy smelled intoxicants, but was unable to administer field sobriety tests because Kitchen was injured, the report said.

Kitchen was transported to Munson Medical Center for treatment and a search warrant was authorized for a blood draw that determined his blood alcohol level was .17 percent, the report said.

Kitchen was convicted of impaired driving in 2005 and of drunken driving, second offense in 2008. Both convictions were in 85th District Court in Benzie County.

Kitchen’s probable cause conference is set for Jan. 3 and his preliminary examination is set for Jan. 10.
