Kitchen faces felony charge

A 37-year-old Thompsonville man waived his preliminary examination on a charge of drunken driving, third offense, and was bound over to 13th Circuit Court.

Benjamin J. Kitchen is currently free on a $10,000 personal recognizance bond.

The felony charge stems from a Nov. 21 accident on South Plowman Road in Empire Township in which Kitchen was driving, according to a court report.

A deputy allegedly smelled intoxicants on Kitchen, but was unable to administer field sobriety tests because of Kitchen’s injuries, the report said.

Kitchen was taken to Munson Medical Center for treatment. A search warrant was authorized for a blood draw that determined his blood alcohol level was .17 percent, the report said.

Kitchen was convicted of impaired driving in 2005 and of drunken driving, second offense in 2008. Both convictions were in 85th District Court in Benzie County.

Kitchen’s next court date has not been set.
