‘Not guilty’ plea to driving felony

A 48-year-old Leland man pleaded not guilty on Wednesday to drunken driving, third offense.

John C. Harbottle Jr., of 1043 N. Manitou Trail, entered the plea after waiving his preliminary examination on the charges and being bound over to Circuit Court.

Harbottle is currently free on a $5,000, 10 percent bond.

The case stems from a Dec. 27 incident in which Harbottle was pulled over on North Manitou Trail for a broken headlight, according to a court report.

A deputy smelled alcohol and after Harbottle failed field sobriety tests, he blew a .17 percent alcohol level on a PBT done at the scene, the report said. Two Breathalyzer tests done later at the jail showed alcohol levels of .24 percent, the report said.

Harbottle was previously convicted of driving under the influence of alcohol in 2005 and of drunken driving in 2007. Both convictions were in 86th District Court.

Harbottle has been offered a Sobriety Court plea. That possible plea and sentencing date has not yet been set.
