Past convictions up charges

NICKERSON NICKERSON A 27-year-old Lake Ann man was arraigned in 86th District Court on Tuesday on a felony charge of drunken driving.

David L. Nickerson is currently free on a $50,000 personal recognizance bond.

Nickerson had pleaded not guilty to drunken/impaired driving, second offense, on May 23. That case was dismissed and Nickerson was recharged this week with a felony when it was found that, if convicted, the current charge would be his third offense, according to court reports.

The case stems from a May 14 incident in which Nickerson was allegedly driving 78 mph on M-22 in Elmwood Township, according to reports. After failing field sobriety tests, his breathalyzer samples showed blood alcohol content of .25 percent and .24 percent, reports said.

Nickerson was convicted of drunken driving in 2011 in 86th District Court and in 2015 in 46th Judicial Circuit Court out of Kalkaska.

Nickerson is requesting a courtappointed attorney. His probable cause conference has been set for June 13 and his preliminary examination for June 20.
