Leelanau Township Notice Of Adoption

Please take notice that the Leelanau Township Board of Trustees, at a meeting on August 14, 2018 at 7:00 p.m., at the Leelanau Township Hall, 119 E. Nagonaba Street, Northport, Michigan, Adopted Ordinance No. 3 Of 2018. The full text of the ordinance is as follows:

LEELANAU TOWNSHIP, LEELANAU COUNTY

ORDINANCE NO. 3 OF 2018

ORDINANCE ADDRESSING FLOODPLAIN MANAGEMENT PROVISIONS

OF THE STATE CONSTRUCTION CODE

Community Name: Leelanau Township, County: Leelanau

An Ordinance to designate an enforcing agency to discharge the responsibility of the Township of Leelanau located in Leelanau County, and to designate regulated flood hazard areas under the provisions of the State Construction Code Act, Act No. 230 of the Public Acts of 1972, as amended.

The Township of Leelanau ordains:

Section 1. AGENCY DESIGNATED. Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, the Construction Code Office (community official/position title or name of other entity, agency, firm) of the County of Leelanau is hereby designated as the enforcing agency to discharge the responsibility of the Township of Leelanau under Act 230, of the Public Acts of 1972, as amended, State of Michigan. The County of Leelanau assumes responsibility for the administration and enforcement of said Act throughout the corporate limits of the community adopting this ordinance.

Section 2. CODE APPENDIX ENFORCED. Pursuant to the provisions of the state construction code, in accordance with Section 8b(6) of Act 230, of the Public Acts of 1972, as amended, Appendix G of the Michigan Building Code shall be enforced by the enforcing agency within the jurisdiction of the community adopting this ordinance. www.michigan.gov/deq 2 EQP9242 (2/2017)

Section 3. DESIGNATION OF REGULATED FLOOD PRONE HAZARD AREAS. The Federal Emergency Management Agency (FEMA) Flood Insurance Study (FIS) Entitled “LEELANAU COUNTY, MICHIGAN (ALL JURISDICTIONS)” (study title) and dated

August 28, 2018, and the Flood Insurance Rate Map(s) (FIRMS) panel number(s) of

26089C0119D, 26089C0120D, 26089C0130D, 26089C0135D, 26089C0138D, 26089C0140D,

26089C0270D, 26089C0276D, 26089C0280D, and 26089C0290D (Number(s)) dated August 28, 2018 are adopted by reference for the purposes of administration of the Michigan Construction Code, and declared to be a part of Section 1612.3 of the Michigan Building Code, and to provide the content of the “Flood Hazards” section of Table R301.2(1) of the Michigan Residential Code.

Section 4. REPEALS. All ordinances inconsistent with the provisions of this ordinance are hereby repealed.

Section 5. PUBLICATION. This ordinance shall be effective after legal publication and in accordance with the provisions of the Act governing same.

Cleveland Township Notice Of Adoption Of Amendment

To The Cleveland Township Zoning Ordinance An Ordinance To Amend Article V. Residential District, Section 5.06 Size Of Dwelling.

Cleveland Township Hereby Ordains:

Amendment of Article V. “RESIDENTIAL DISTRICT” of Zoning Ordinance

Article V, Section 5.06 Size of Dwelling is hereby amended:

No single family dwelling shall be hereinafter erected, altered, or moved, on any land or premises in this district which provides for less than seven hundred fifty (750) four hundred eighty (480) square feet of living area in Residential I. (Effective Date August 22, 2015). Multiple family dwellings shall provide a minimum of seven hundred (700) four hundred eighty (480) square feet of living area per unit. Townhouses and condominiums shall be subject to the same size restrictions. The living area herein referred to shall mean the outside dimensions of such area, exclusive of attached garages, porches, or other accessory structures.

(a) Completion: Any dwelling or accessory building or any addition thereto must be completed on the exterior surfaces with suitable finishing material, including painting or staining in the case of wood, within two (2) years from date of issuance of the building permit, except that in such cases where the permit is issued for the building only of a “basement home”, such a home shall be considered a partial home and the super-structure shall be built and completed on the exterior as described above within three (3) years from date of issuance of the original building permit. If proof is shown of hardship, action shall be determined by Zoning Administrator.

Notice is hereby given that on August 14, 2018 an amendment to the Cleveland Township Zoning Ordinance was adopted by the legislative body of the Township of Cleveland.

This ordinance shall become effective 30 days following publication of this Notice of Adoption in the Leelanau Enterprise.

Empire Township Board Minutes

The following is a synopsis of the August 14, 2018 regular meeting of the Empire Township Board. A complete copy of the minutes may be obtained by contacting the Clerk at 231-326-5349.

Supervisor Noonan called the meeting to order at 7:30 p.m. Members present: Deering, Neiswonger, and Deegan. Absent: Price. Minutes of the 07-10-18 regular meeting and 07-27-18 special meeting were approved.

Actions approved by motions: 1) Adopted Resolution 04-2018 that opposes the State of Michigan Assessing Reform Proposal. 2) Approved entering into an agreement with Fleis & Vandenbrink for a space needs and feasibility study for Fire Station No. 2 in Empire at the proposed fee of $14,300.00. 3) Paid monthly bills. 4) Amended the Special Event application to include the word “Policy” in the title.

Leelanau County Road Commission Notice

Public Hearings-Leelanau County Road Commission

The Board of County Road Commissioners has scheduled public hearing during their Tuesday, September 4, 2018 regular meeting at 1:15 p.m. at the Suttons Bay garage located at 10550 E. Eckerle Road, Suttons Bay, Michigan.

The purpose of this public hearing is to listen to comments/questions concerning a request from the Michigan County Road Commission Self- Insurance Pool for the Roads Commission to adopt two resolutions:

The first is a “Resolution to Adopt Reasonable Policy Regarding Fees Pursuant to MCL 224.19b” for Communications Service Providers.

The second is a resolution to revise the Road Commission’s “Telecommunications and Video Service Provider Right-of-Way Permit Policy” and Fee Schedule.
