Board waives attorney/client privilege

Nearly a month after the race for seats on the Cherryland Electric Cooperative were decided, the county board continues to wrestle with lingering issues over the county administrator’s candidacy.

Commissioners recommended approval of a waiver of “legal privilege” Tuesday to address a pending Freedom of Information request for a legal opinion provided the county by legal counsel Matt Nordfjord as to whether election to the Cherryland Board would fall under Section 6 of Dyer’s contract as to “outside employment.”

The request for the opinion was made by county board Chairman Steve Yoder after Dyer was called out by commissioners and members of the public claiming Dyer’s election to the utility board would conflict with his position as the county administrator.
