NOTICE OF FORECLOSURE BY ADVERTISEMENT
Notice under MCL 600.3212: Pursuant to MCL 600.3212, if the property is sold at a foreclosure sale under MCL 600.3201 et. seq., the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or the mortgage holder for damaging the property during the redemption period.
ATTENTION POTENTIAL PURCHASERS AT FORECLOSURE SALE: In the case of resolution prior to or simultaneously with the aforementioned foreclosure sale, Honor Bank may rescind this sale at any time prior to the end of the redemption period. In that event, your damages, if any, shall be limited to the return of your bid amount tendered at the sale, plus interest.
Attention homeowner: If you are a military service member on active duty, if your period of active duty has concluded less than 90 days ago, or if you have been ordered to active duty, please contact the attorney for the party foreclosing the mortgage at the telephone number stated in this notice.
Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in the County of Leelanau, State of Michigan, starting promptly at 1:00 p.m., on September 6, 2023, in the main lobby of the Government Center, which is located at 8527 E. Government Center Drive, Suttons Bay, Michigan. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information.
This notice relates to a Mortgage in the amount of $52,000.00 made by Dean Knizacky, a single man (“Mortgagor”) to Honor Bank, dated June 6, 2017, and recorded in the Office of the Register of Deeds for the County of Leelanau in the State of Michigan on June 13, 2017, in Liber 1297, Page(s) 908, et. seq., on which Mortgage there is claimed to be due as of the date of this Notice the sum of $52,132.48, together with interest at 4.375 percent per annum.
NOW THEREFORE, there will be offered at public sale, the premises, or some part thereof, described in said Mortgage as follows, to-wit:
Land situated in Elmwood Township, Leelanau County, Michigan, to-wit:
Unit 29, Sun Perch, according to the Consolidating and Amended and Restated Master Deed recorded in Liber 957 on Page 637, and First Amendment to Consolidating and Amended and Restated Master Deed recorded in Liber 979 on Page 543 and Second Amendment to Consolidating and Amended and Restated Master Deed recorded in Liber 1109 on Page 346, and designated as Leelanau County Condominium Subdivision Plan No. 1, together with rights in general common elements and limited common elements as set forth in above Master Deed and as described, in ACT 59 of Public Acts of 1978, and amendments thereto.
Said premises are commonly known as 10976 S. Blue Ridge Lane, Traverse City, Michigan 49684.
The redemption period shall be six (6) months unless the property is established to be abandoned pursuant to MCL 600.3241a, in which case the redemption period shall be the later of thirty (30) days from the date of sale or fifteen (15) days from the date the notice required by MCL 600.3241a(b) was posted and mailed, or unless under MCL 600.3240(16), prior to the foreclosure sale the borrower follows the procedure set forth in that section to establish the presumption that the property is used for Agricultural purposes, in which case the redemption period shall be one (1) year from the date of the sale.
